6. Safety

As a Landlord you need to ensure the safety of your tenants and their guests.

Some requirements are mandatory, such as the Landlords gas safety and Electrical Safety Certificates. Both of which need to be conducted by a Gas Safe Registered contractor and a qualified Electrician respectively.

Others such as the Legionnaires assessment are required to be compliant but have not been enforced by legislations as of yet. However, if an incident were to occur, the landlord would be required to prove they had taken due diligence in ensuring the property was safe and fit for rental purposes.

In which case it is prudent to have these checks carried out by a competent tradesperson before the start of any tenancy and on a regular basis as advised. Smoke detectors are now mandatory on every floor in rental properties. CO detectors are currently only required where there is a solid fuel burner however again it is advisable that these are installed as per the manufacturer’s instructions in any room where there is a gas appliance.

All smoke detectors and CO detectors must be tested and in working order upon the commencement of any tenancy and throughout. It is worth noting in your Agent’s Agreement as to whether the Agent undertakes the responsibility of testing these or whether this remains with the landlord.
